This is assessed by considering whether your treatment falls below the standard of a reasonably competent dental professional/Hospital Trust by applying what is often referred to as the Bolam test and by reaching the civil courts’ standard of proof – “the balance of probabilities” – which means it must be more likely than not (51%) that the negligence has caused the harm which you have suffered.
